1. Acceptance of Terms
By accessing or using DramWell.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Description of Service
DramWell provides an AI-powered operating system for hospitality businesses, including AI agents, communications tools, CRM, marketing automation, and analytics. Features vary by subscription plan.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.
4. Billing & Payments
Paid plans are billed monthly or annually. You may cancel at any time, and access continues through the end of your billing period. Refunds are handled on a case-by-case basis.
5. Acceptable Use
You agree not to misuse the Service, including sending spam, violating laws, or interfering with other users. We reserve the right to suspend accounts that violate these terms.
6. SMS/Text Messaging Program Terms
DramWell enables hospitality businesses to communicate with their customers via SMS/text messaging. The following terms apply to all SMS programs operated through the DramWell platform.
Opt-In and Consent. Subscribers opt in by providing their phone number through a DramWell-powered web form, in-venue sign-up, or by texting a keyword (e.g., START, SUBSCRIBE, YES) to a designated campaign number. By opting in, subscribers consent to receive recurring promotional and/or transactional text messages from the subscribing venue or brand.
Message Frequency. Message frequency varies by program. Subscribers can typically expect 2–15 messages per month depending on the venue's campaign settings.
Message and Data Rates. Message and data rates may apply. Your carrier's standard messaging and data rates apply to all messages sent and received. Contact your wireless carrier for details about your messaging plan.
Opt-Out. You may opt out of any SMS program at any time by texting STOP to any message received. You will receive a single confirmation message and no further promotional messages will be sent.

Supported Carriers. SMS programs are available on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
No Mobile Data Sharing. Mobile phone numbers, SMS opt-in data, and personal information collected through any DramWell SMS program will never be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. See our Privacy Policy for complete details.
Compliance. All SMS programs operated through DramWell are administered in compliance with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles, and all applicable federal and state regulations.
7. Limitation of Liability
DramWell is provided "as is" without warranty. We are not liable for indirect, incidental, or consequential damages arising from use of the Service.
